2257 Background

In June of 2005, the Attorney General of the United States released draconic new rules aimed at devastating the American porn community under the guise of protecting children. These rules were aimed in particular against secondary producers, those people that reproduce or distribute pornography made by another person. Until this point secondary producers had been specifically exempt from record-keeping requirements as mandated by the Tenth Circuit Court of Appeals in Sundance v. Reno.

A lawsuit, Free Speech Coalition v. Gonzalez, was immediately filed in federal court. In December, 2005 the judge issued a formal injunction against enforcement of parts of the law. The court found that the lawsuit will likely result in overturning the rules against secondary producers. Accordingly, his injunction forbade the government from enforcing 2257 laws against secondary producers. Years later the case still meanders through the federal court system.

The injunction, however, only covers members of the Free Speech Coalition. In the meantime, secondary producers that are not Free Speech Coalition members risk arrest, seizure of business assets, and prison time when they show pornographic images for which they do not posess model IDs. While we are a member of the FSC, in the years since the injunction the FBI has violated it by continuing secondary producer inspections against both FSC and non-FSC members.

This is why we do not display sexually explicit images.

2257 Compliance

GayGeek does not display pictures of full frontal nudity or sexual activity. Accordingly, GayGeek is not a primary or secondary producer as defined under USC 18, Part I, Chapter 10, Section 2256 and is not affected by Section 2257 requirements regarding record keeping.

Website and content feed listings

It is our policy to list only websites and content feeds that contain adults over 18 years of age. We do not list or review websites that advertise "lolitas," "child art," or otherwise suggest models are under 18 years of age.

To the best of our knowledge all listed membership sites, pay-per-view sites, and content feeds containing depictions of sexual activity are in compliance with Section 2257 laws.
